Welcome to The Product Dev (the “Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website at https://theproductdev.com/ (the “Site”) and any services, software, or data engineering solutions provided by the Company (collectively, the “Services”).
By accessing the Site or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.
The Product Dev provides financial analytics engineering, including but not limited to:
2.1 No Professional Advice: While our Services provide audit-ready data and financial automation, The Product Dev is a data engineering firm, not a certified public accounting (CPA) firm or legal consultancy. Our output is intended to support your financial operations, but final financial reporting and tax compliance remain the responsibility of the Client’s internal finance team.
2.2 Data Accuracy: Our models rely on the data provided via your integrations (e.g., QuickBooks, Stripe, Salesforce). We are not responsible for inaccuracies caused by incorrect or “dirty” data originating from your third-party software sources.
3.1 Company IP: All techniques, proprietary code snippets, methodologies, and processes owned by The Product Dev prior to an engagement remain the sole property of the Company.
3.2 Client Deliverables: Upon full payment, the specific SQL models, dashboards, and custom software built specifically for your organization (“Deliverables”) will be licensed to or owned by you, subject to the terms of your specific Service Agreement.
You agree not to:
Our Services interact with third-party platforms (e.g., Snowflake, dbt, AWS, BigQuery). Your use of these platforms is subject to their respective terms and conditions. We are not liable for service interruptions or data breaches occurring within third-party environments.
To the maximum extent permitted by law, The Product Dev shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or revenue, arising out of your use of the Services or reliance on financial models provided by us. Our total liability for any claim shall not exceed the amount paid by you to the Company in the six (6) months preceding the claim.
You agree to indemnify and hold harmless The Product Dev and its employees from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms or your misuse of the data/models provided through our Services.
Both parties agree to protect “Confidential Information” (including financial data, business logic, and trade secrets) with reasonable care and not to disclose it to third parties without prior written consent, except as required by law.
We reserve the right to terminate or suspend access to our Site or Services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.
These Terms shall be governed by and construed in accordance with the laws of Puerto Rico, without regard to its conflict of law provisions.
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the “Last Updated” date.
